Flat Rate Dispute Resolution Service

Introduction

Take advantage of the benefits of aADR without the necessity to Design Your Own Dispute Resolution System.  Our Flat Rate Dispute Resolution Service (FRDRS) combines all the advantages of aADR with a simple fee arrangement.  

Procedure

The Flat Rate Dispute Resolution Scheme is a packaged alternative dispute resolution scheme whereby on application and payment of a non-refundable deposit:

  1. CINDAR reviews the information provided to it to decide whether one or more of its aADR methods is likely to be suited to the nature and value of the dispute.
  2. At no cost to the parties (save for the application fee), CINDAR provides a report outlining the nature of the dispute and recommending one or more of its aADR methods and providing details of a neutral third party who can assist the parties in achieving a resolution.  If we think that we cannot be of assistance then we will say so and recommend the parties pursue a course of action prescribed by their contract, typically, adjudication or litigation.
  3. This report is provided to the party making the application (or their legal representatives, if appointed) and will be suitable for passing to the other party for the purposes of engaging them in the process.  If the other party is unwilling to participate then CINDAR will contact the other party with a view to bringing them into the process. 
  4. On acceptance by the parties to the process described in the report and on execution of the FRDRS Agreement,  the party making the application pays 3% of the amount claimed (and the responding party pays 3% of the value of any counter-claim).
  5. The Neutral then enters into the reference and a decision or recommendation is issued/made according to the process adopted.
In the event that one of our aADR methods would provide a cheaper solution than the flat rate scheme (having regard to the value of the dispute and the procedure recommended, then that fee rate will apply in lieu of the flat rate).
